YOUR LEARNING AGREEMENT

Terms & Conditions

Terms of Service for LingoTab.com.

Revised November 2026

Internal review note — remove this note before publication. This is an original consumer agreement for LingoTab.com, its website and mobile language-learning applications. It assumes an adult-only launch, Stripe website payments, a seven-day trial without a card or automatic conversion, and the proposed first-payment refund policy in section 11. These are drafting recommendations, not approved business policies or implemented features. The privacy-officer details, telephone number, governing province, effective date, plan limits and supported territories remain to be finalized. Regional provisions require local review. Read the accompanying Terms Planning and Launch Review before using this draft. A Canadian lawyer should review the final agreement and coordinate necessary local advice for launch countries.

1 Your agreement with LingoTab.com

These Terms of Service govern your personal use of the LingoTab.com website, mobile applications and related language-learning features that identify these Terms as applying to them. We call these the Services. “LingoTab.com”, “we”, “us” and “our” mean the Canadian corporation identified above. “You” means the individual using the Services or buying a subscription for their own use.

Please read these Terms, the plan details shown before you order, and our Privacy Notice at https://lingotab.com/privacy.html. You enter this agreement when you select the acceptance control presented with these Terms. A purchase also requires your express acceptance of the price, billing interval and any recurring payment authorization shown at checkout. Visiting an informational page does not, by itself, authorize a charge.

Our Privacy Notice explains our handling of personal information. Accepting these Terms does not provide blanket consent to optional data uses, advertising, voice recording or model training. We obtain separate permissions or consent where required.

Mandatory consumer laws apply first. Section 28 contains regional provisions that take priority over conflicting general provisions. A specific benefit expressly promised in your order or offer remains part of your agreement. We do not use these Terms to remove a right or remedy that the law gives you.

2 Age and eligibility

You must be at least 18 years old and have legal capacity to enter this agreement where you live. If the applicable minimum age or age of majority is higher than 18, that higher requirement applies. The Services covered by these Terms are not offered to people below that age. A parent or guardian cannot use consent to make an ineligible person eligible under this agreement.

Provide accurate eligibility information. We may take proportionate steps to confirm age or investigate information that reasonably indicates ineligibility. Our Privacy Notice describes personal information used for those steps. We may pause access while resolving a reasonable eligibility concern. If an account belongs to an ineligible person, we will close it, stop future charges under our control, and handle refunds and personal information according to applicable law and our Privacy Notice. We do not automatically forfeit prepaid fees solely because of age ineligibility.

You must also be in a territory in which the selected Services can lawfully be supplied. Do not misrepresent your age, location or identity to bypass an eligibility or availability restriction.

3 What the Services provide

LingoTab.com provides language-learning materials and practice. Depending on the course, plan, device and location, features may include stories and dialogues, vocabulary, grammar guidance, listening, reading, writing, speaking, interactive exercises, games, AI explanations, translations, recorded speech feedback, and AI conversation practice. Where enabled, optional community features add topic discussions, short posts, friendly corrections, shared learning milestones and weekly group challenges.

Available courses, languages, guidance languages, levels and features are those identified in your plan and the current course catalogue. A demonstration, roadmap, prototype, coming-soon label or AI-generated suggestion is not a promise that a course or feature is available. Selecting a preferred guidance language does not guarantee a complete reviewed course in that language.

The target language is the language you practise. Explanations or assistance may use another supported language. You can change available learning preferences through the controls provided. Preference changes do not by themselves purchase another subscription.

The Services support personal education. Results depend on your practice, circumstances and other factors. Course labels, points, streaks, badges, AI feedback and completion records do not establish independently assessed proficiency. We do not guarantee fluency, examination results, employment, immigration outcomes or an accredited qualification. Any accredited service would require a separate express agreement identifying it.

4 AI tutors and educational feedback

Our AI tutors, characters, avatars and generated voices are software features. An AI conversation is not a conversation with a human teacher, even when it uses a human-like name, image or voice. Some lessons and audio are prepared in advance; other responses are generated when you use a feature. We identify AI interaction in the relevant interface.

AI can make mistakes, misunderstand speech, give incomplete explanations, produce biased or unsuitable material, or generate similar responses for different users. Translation, speech recognition and pronunciation feedback can be affected by accents, dialects, disabilities, microphone quality, background noise and connection problems. Ask for clarification or report feedback you believe is wrong. An alternative valid answer may need review.

Tutoring may use your selected language preferences, current chapter or activity, submitted attempt and available learning context. That context may be incomplete or based on device-reported activity. A response does not amend an official learning record or grant subscription access. During unfinished exercises the tutor may give hints or different examples instead of the answer.

Use AI output as educational assistance and exercise reasonable judgment. The Services are not medical, mental-health, legal, financial or emergency services. They are not monitored as a crisis channel. Contact an appropriate local professional or local emergency service when you need that kind of help.

We may refuse unsafe requests, interrupt an unsafe session or offer a safer learning activity. Safeguards reduce risk but cannot guarantee that every response will be suitable. Report harmful or materially inaccurate content to [email protected], preferably with the relevant lesson or conversation details and without including unnecessary sensitive information.

5 Accounts and account security

Some features require an account. Keep registration and billing contact information accurate, choose secure sign-in credentials, and protect access to your devices. Use your own account. An individual subscription is for one learner unless your order expressly provides otherwise.

You are responsible for activity you authorize through your account. Tell us promptly at [email protected] if you suspect unauthorized access or a payment problem. You are not made automatically responsible for every unauthorized action merely because it occurred through your account. Responsibility depends on the facts and applicable law.

Do not sell or share your account, impersonate another person, or use multiple accounts to evade trial eligibility, access controls or usage limits. You may use supported personal devices, subject to disclosed plan limits. Any family, school, employer or team arrangement requires a separately offered plan and its applicable terms; these Terms do not create an organizational plan.

6 Guest access and saved progress

Where offered, guest access lets you try certain features without creating an account. Guest records may be stored on the device or browser and may not be recoverable after browser-data clearing, uninstalling, changing devices or losing access to that device. Sign in and use the available transfer or backup controls if you want supported account features.

Account saving, offline access and synchronization apply only to the features and platforms identified as supporting them. An internet connection and successful synchronization may be needed before work is available on another device. A pending or conflicting save may require your action. Do not assume that an unsynchronized device copy has reached your account.

Trial expiry or ordinary subscription cancellation does not by itself constitute a request to delete your account. Access to paid content can end while your account records remain subject to the retention rules in our Privacy Notice. We do not promise indefinite storage. We will honour applicable access, correction, portability and deletion rights.

7 Seven day free trial

If you are eligible for our standard trial, you receive seven consecutive days of access to the trial features identified when you activate it. The trial starts at the activation time and ends 168 hours later. We show the start or expiry details in the activation confirmation, with the relevant time zone. Uninstalling the app, signing out or not using the Services does not pause the trial.

Our standard trial does not require payment details and does not automatically become a paid subscription. At the end of the trial, trial-only access ends unless you separately choose and purchase a subscription. You will not be charged merely because the trial ended. You may stop using the trial at any time without a cancellation fee.

Unless an offer expressly provides otherwise, one standard trial is available per individual. We may decline duplicate or fraudulent trial requests using proportionate checks. The trial offer states any excluded courses or AI allowances; trial access does not mean unlimited AI use or access to future courses.

If you choose to buy a subscription during the trial, checkout will show when paid service starts and whether the remaining free days continue. We will not end promised free days early or charge you early without your express choice. A service failure during the trial does not authorize an automatic payment.

8 Choosing a subscription

Before you buy, we show the plan name, included courses and features, AI allowances, any device or account limits, currency, total payable price and applicable taxes, billing interval, access start, renewal method, cancellation method and relevant refund rights. You have an opportunity to correct purchase details before confirming.

Monthly and annual plans, where offered, are different billing commitments. An annual plan is charged at the total annual price shown, unless checkout expressly offers instalments. A monthly equivalent displayed for comparison does not turn an annual charge into monthly billing. We offer a billing arrangement in a territory only where that arrangement is legally available.

Your order confirmation records what you purchased. We provide it in a form you can keep. Review it and contact us if it does not match the offer you accepted. We do not make you buy advertised-but-unavailable features to use the features included in your order.

9 Stripe payments and automatic renewal

Website payments are processed through Stripe using payment methods made available at checkout. LingoTab.com remains your service provider unless the checkout expressly identifies a different seller. Stripe and your payment provider may have terms concerning their own payment services. Those terms do not remove LingoTab.com's obligations to you.

When you expressly choose an automatically renewing plan, you authorize the disclosed subscription charge at the start of each billing period until you cancel. The amount, currency, interval and next renewal date are shown before purchase and in your subscription information. We obtain any additional authorization required by law. A one-time purchase or nonrenewing plan does not authorize recurring charges.

We do not add undisclosed mandatory service, processing or administration fees. Applicable taxes and any currency-conversion charges imposed independently by your bank or payment provider are identified where they can reasonably be determined. Where law requires tax-inclusive pricing, the price is displayed on that basis.

If a payment fails, we may notify you and retry the authorized payment in accordance with the disclosed payment process. We may pause paid access after reasonable notice. A retry does not create a new subscription or a higher price. We do not charge an undisclosed late fee. Cancellation stops future renewals; a payment lawfully due for service already supplied may remain payable, subject to your rights.

10 Cancelling a subscription

You can cancel a website subscription through the subscription-management link available in your account or order confirmation. If the link fails or you cannot access your account, send a clear cancellation request to [email protected]. Include enough information for us to identify the subscription securely. We will not require a telephone call or a retention conversation to cancel a website purchase.

For ordinary cancellation, cancel before the next renewal time shown in your account to prevent that renewal. We do not impose a separate 24-hour cancellation cutoff on website purchases. A clear cancellation request sent before that time will be honoured even if we process it later. If we incorrectly take a renewal payment after timely cancellation, we will refund it.

Ordinary cancellation stops future renewal and leaves access in place until the end of the period already paid for. There is no early-cancellation penalty. If you instead exercise a legal withdrawal right, request an eligible refund, or request immediate termination, the applicable rules may end access sooner and require a refund. Section 28 explains certain regional rights.

We provide cancellation confirmation and the date paid access ends. Uninstalling the app or signing out does not cancel a subscription. Section 18 explains account deletion. App-store purchases, if offered, use the additional process in section 17.

11 Refunds and consumer remedies

Proposed first-payment guarantee. For a subscription bought directly from LingoTab.com through our website, you may request a full refund of your first subscription payment within 14 calendar days after that payment. This voluntary guarantee applies even if you have used the Services. Contact [email protected] or use the available refund control. It applies once per individual and is additional to all legal rights. It does not automatically apply to later renewals or purchases billed by an app store. Refunded paid access ends when the refund is processed, unless the applicable remedy requires otherwise.

After that voluntary period, ordinary cancellation does not normally refund a completed billing period or the unused part of that period. This does not affect a statutory cooling-off right, a mandatory right to a proportionate refund, an unauthorized or duplicate charge, a charge after timely cancellation, a failure to provide the promised service, or another remedy required by law. A local right may apply to a renewal even when the first-payment guarantee does not.

If a material paid feature is unavailable or materially fails to match what you bought, contact us. Depending on your rights and the circumstances, the remedy may include correction, restored access, a price reduction, cancellation or a refund. We will not replace a required money refund with credits without your agreement.

We issue approved refunds to the original payment method where possible and within any legally required period. Payment providers may take additional time to post the credit. Tell us about a billing issue so we can investigate, but contacting us first is not a condition of a lawful bank dispute, chargeback, regulatory complaint or court remedy.

12 Prices and plan changes

We may offer different plans, promotions or prices for future purchases. An existing fixed paid period keeps its agreed price. We do not retrospectively charge for free access or for service already supplied.

If we propose to increase a recurring price or materially reduce included benefits at renewal, we will give you at least 30 days' clear advance notice, and any longer notice required by law. The notice states what changes, the effective date, the new price or benefits, and how to cancel. We obtain express consent where required. If consent is needed and not obtained, we do not charge the changed price; the affected subscription ends at the end of the agreed period unless a lawful alternative is agreed.

Upgrades, downgrades and billing-frequency changes require your choice. Before confirmation we disclose their effective date, any immediate charge, and any credit or proration. We do not use a change of plan to waive a refund or cancellation right.

13 AI usage limits and fair use

AI text, generated audio, speech feedback and conversation features may have separate session, daily or other limits. The plan and relevant feature explain the allowance, how it is counted, the reset period and any session timer. We show material limits before purchase. A local prototype's allowance is not an entitlement unless included in your offer.

The subscription does not permit automated bulk extraction, resale of AI access, credential sharing, or deliberate circumvention of safety or usage controls. We may apply proportionate safeguards to protect security and service availability. We do not use an undisclosed fair-use rule to remove a specifically promised allowance.

When an included allowance is exhausted, the feature may pause until it resets. We do not automatically bill for extra usage. Any paid add-on requires clear pricing and your separate authorization. Outages and failed sessions are handled reasonably and remain subject to section 11 and mandatory remedies.

14 Microphones recordings and personal information

Microphone access requires permission through the controls provided by your device or browser. Giving device permission does not by itself authorize every possible use of a recording. Before a feature sends your speech for AI processing, the relevant notice explains the processing and links to our Privacy Notice. Stop, mute and recording controls apply to the feature in use; stopping a stream does not itself delete information already transmitted.

Depending on the feature, the Services may process your audio, transcripts, submitted text, AI replies, learning preferences and lesson context. Some practice may be local to your device; other features send information to our systems and selected providers. Do not assume all recordings remain on your device, that all conversations are permanently recorded, or that all information is deleted when a session ends. The Privacy Notice describes actual retention, providers, processing locations, international transfers, human access where applicable, and your rights.

Use fictional details for roleplay when appropriate. Avoid submitting passwords, payment-card details, identity documents, sensitive health information or another person's private information into learning conversations. Do not record or submit another person's voice without appropriate permission. A request to practise pronunciation does not authorize voice cloning, biometric identification or public use of your voice.

Any separate use of personal information to train or improve general-purpose AI models must have an appropriate lawful basis, be explained clearly, and obtain consent where required. These Terms do not grant blanket permission for that use. You can contact our privacy contact to exercise applicable privacy rights or ask about a feature's data handling.

15 Your learning submissions and our content

As between you and LingoTab.com, you keep any rights you hold in text, audio and other material you submit. You give us a limited, nonexclusive permission to process that material as reasonably necessary to deliver the requested features, maintain your learning records, display community contributions to the audience you choose, moderate community content, secure the Services and provide support, subject to our Privacy Notice and applicable law. We may use service providers for those purposes under appropriate arrangements. This permission is limited to those purposes and the applicable retention period; it is not a right to sell your voice or publish your private conversations for marketing.

Feedback you deliberately send about improving the product may be used to develop improvements without payment to you. We will not treat a private learning submission as a public testimonial or advertising endorsement without separate permission.

We and our licensors retain rights in the software, authored curriculum, stories, characters, artwork, recordings, course structure, branding and other content we provide. Subject to your lawful access, you receive a personal, nonexclusive licence to use that content for your learning through the Services. Downloads or printouts are permitted where a feature expressly provides them. Subscription access is not a sale of the curriculum or source assets. Statutory exceptions, accessibility rights and other nonwaivable rights remain available.

You may use AI-generated examples supplied to you for personal study. AI output may be similar to other output, may contain third-party material, and may not qualify for copyright protection. We do not promise exclusive ownership of it or rights we do not have. Check appropriate rights before publishing or commercially exploiting material.

16 Responsible use and community rules

Use the Services lawfully and with respect for others. You must not:

  • submit unlawful threats, harassment, exploitative sexual material, or content that violates another person's rights;
  • use the Services for fraud, identity theft, malicious code, phishing or unauthorized access;
  • deliberately bypass safety controls, age restrictions, payment requirements or rate limits;
  • scrape or redistribute substantial course content, resell access, or use automated tools to extract restricted material without permission, except where applicable law permits the activity;
  • infringe intellectual property, impersonate people, or submit recordings or confidential information you lack permission to use;
  • manipulate progress or rewards through bots or fabricated events, or disrupt another learner's use.

Lawful criticism, a good-faith security report, requesting a refund, or challenging an AI answer is not prohibited. Report a suspected security or intellectual-property issue to [email protected] with enough detail for us to investigate. Do not access other people's accounts or unnecessarily disclose their information while making a report.

Learning together

Our first community phase is planned for English and Spanish, with topics such as everyday life, work and travel. It is for language learning: ask a question, write a short practice response, offer a constructive correction or celebrate a learning milestone. Learners and native speakers participate as peers; a self-described native speaker is not a verified teacher. Corrections can be mistaken, and we do not guarantee a reply, a partner match or professional tuition. Community participation is optional and is not required to continue your lessons.

Profiles and sharing your progress

The planned community requires a signed-in, eligible account and acceptance of these rules before creating or uploading content. You choose a community display name and any available avatar; do not impersonate someone else. A profile used for posting identifies your contribution to its displayed audience. Your sign-in email and other private account details are not community profile fields.

Your streaks, earned trophies, current chapter and recent learning milestones are private to other members by default. You may choose which supported progress details to share and turn sharing off again. Completing a lesson does not automatically create a community post. A milestone post requires your choice; any future automatic sharing would need a separate opt-in. Choosing not to share does not reduce earned lesson progress or rewards.

Lesson answers, mistakes, assessment details, microphone recordings and private Oli conversations are not published to the community or included in progress-sharing cards. A short response you deliberately write as a community post is different from a private exercise answer. Check the audience shown before posting. Other members may copy or capture what they can see, so avoid sensitive details. Turning off profile sharing stops further display of those progress fields; it does not remove an earlier milestone post, which must be deleted separately.

Treat people respectfully

These rules apply to posts, replies, profile names, avatars, images, links, challenges and any other contribution allowed by a feature. A rule about media does not mean image, audio or video uploads are available. You must not post or use the Services to distribute:

  • Abuse, bullying, personal insults, targeted profanity, harassment, stalking, threats or attempts to intimidate or humiliate another person. Do not mock accents, language ability, mistakes or disability.
  • Hate speech, slurs, discriminatory attacks or dehumanizing content targeting a person or group because of characteristics such as race, nationality, ethnicity, religion, sex, gender identity, sexual orientation or disability.
  • Pornography, nudity or sexually explicit material; sexual harassment or solicitation; non-consensual intimate images, including manipulated or AI-generated images; or any child sexual abuse, exploitation, grooming or trafficking content.
  • Graphic violence, gore, cruelty, terrorist recruitment, or content promoting violence, self-harm, exploitation or dangerous illegal acts.
  • Obscene or offensive images and material unsuitable for a respectful language-learning community. Apply the same standards to profile pictures, memes, links and AI-generated content as to written posts.
  • Someone else's private information, identifying documents, address, contact details, private messages, photographs or recordings without the rights and consent needed to share them. Do not expose or threaten to expose private information.
  • Scams, phishing, malware, impersonation, misleading claims of staff or teacher status, or fabricated claims about another member intended to harm them.
  • Spam, repetitive or irrelevant posts, unsolicited advertising, commercial solicitation, or links intended to divert members into scams or inappropriate services.
  • Copyright-infringing images, copied paid lessons or other content you do not have permission or a lawful right to share. Do not use another person's likeness to deceive or harass.
  • Bots, coordinated fake engagement, duplicate-account reward farming, fabricated milestones, or attempts to evade blocks, moderation or account restrictions.
  • Knowingly false reports, retaliatory reporting, organized harassment or pressure on another learner to share personal details, continue an unwanted interaction or move off the platform.

Give friendly, specific corrections about the language, not judgments about the person. Respect a request to stop. Good-faith mistakes, respectful disagreement, lawful criticism of LingoTab.com and legitimate safety reports are not abuse. These exceptions do not permit targeted harassment or prohibited imagery. Do not repost harmful content to complain about it; use the reporting route instead.

Reporting blocking and moderation

Before community access opens, we will provide in-app and website reporting and blocking controls wherever the community is available, content filtering, published safety contact details and a human moderation dashboard. Report a post or member using the Report control, choosing a reason and adding only the details needed. You can also contact [email protected]. Block a member to limit their interactions with you through the controls provided. Blocking does not automatically remove their content for everyone or create a safety report; use Report as well when a rule has been broken.

Automated filters may hold or restrict content for review. Authorized human moderators review reports and relevant context, and can warn members, remove content, limit posting, suspend community access or close an account for serious or repeated violations. We prioritize urgent safety reports and act on concerns promptly; this is not a promise of round-the-clock monitoring or an immediate response to every post. Community reporting is not an emergency service; contact local emergency services for an immediate danger.

We consider the context, severity and repetition of a violation. Serious safety risks can require immediate removal or suspension without a warning. Where lawful and safe, we explain the rule involved and how to request human review at [email protected]. Appeals are considered by an authorized reviewer, and mistaken decisions can be corrected. We protect reporter information and restrict access to moderation records, subject to lawful disclosure. Moderation cannot guarantee that no harmful content will ever appear. Account and payment consequences remain subject to section 19 and mandatory rights.

Your community content

You keep the rights you hold in your contributions. You give LingoTab.com a nonexclusive, royalty-free permission to host, store, format and display them to the audience indicated by the feature, and to process them for moderation, reporting and safety. Providers may help carry out those limited purposes. This is not ownership of your content, permission to publish private learning records, or permission to use your posts, name, image or voice in advertising or unrelated model training.

You must have the rights and consent needed for anything you post. Use the supplied controls to edit or delete your own posts where offered, or request removal through support. Removal from community view does not immediately erase restricted backups or records reasonably retained for safety, a dispute or a legal obligation. The Privacy Policy explains those limits. The permission ends when the content is deleted from our systems, except for limited retention required for those purposes. Other members may have made independent copies; we cannot promise to recall them. Report unauthorized use rather than redistributing it.

Challenges and meaningful participation

Weekly group challenges and milestone sharing are optional. Any community reward offer will identify qualifying actions and caps before participation. Rewards recognize meaningful learning or helpful contributions; repeatedly posting, reacting, copying the same response or recruiting fake accounts cannot generate unlimited points. We may withhold or correct rewards obtained through abuse, with a route to request review. Rewards have the limitations in section 21 and are not cash, wages or a professional credential.

Coming soon: partners and private exchanges

Coming soon: we plan to add partner search by language, nationality or location, and mutually accepted text chats, voice messages and live conversations with native speakers. These private exchanges are not part of the first community phase and are not currently available. They are intended to support natural phrasing and cultural understanding, without a guarantee of a partner match, reply or learning outcome.

Nationality and country or city will be optional, self-declared profile fields. Members choose their discoverability and can hide those fields or stop appearing in partner search. A shared language, nationality, location or topic group does not entitle anyone to contact another member privately, start a call or access private lesson recordings. Respect refusals, consent choices and blocks. Do not record, capture, redistribute or publish another person's voice, messages or live conversation without their permission and any consent required by law.

Before offering these features, we will provide specific privacy and safety notices, mutual acceptance controls, reporting and blocking, and updated terms where needed. These community rules will apply to text, voice and live interactions. We do not promise end-to-end encryption or confidential professional advice for a future feature.

17 Mobile applications and app stores

The mobile app may require a supported operating system, sufficient device storage, an internet connection and permissions appropriate to the feature. Your network provider may charge for data. We identify relevant technical requirements before purchase and provide updates required by applicable law.

Where Apple App Store or Google Play purchasing is offered, the purchase screen identifies the store, seller, billing terms and cancellation route. Store purchases may need to be managed through that store's subscription controls. Store prices and offers may differ from website offers. Do not buy twice assuming an existing subscription will automatically cancel. Cross-platform access applies only as stated in your purchased plan.

Refunds for store-billed purchases use the store's available process, with our assistance where appropriate, and remain subject to applicable consumer rights. Our website first-payment guarantee applies to store purchases only if their offer expressly includes it. A store's involvement does not remove responsibilities that applicable law places on us.

If you obtain an Apple app, your licence is also subject to Apple's applicable standard end-user licence agreement unless a valid custom licence is supplied with that app. These service Terms do not replace mandatory store licence terms. Any future custom app licence will identify its additional requirements. Platform rules concerning payment routes apply in the countries and circumstances where required.

18 Closing your account and deleting information

You can request account closure and deletion through the account controls provided or by contacting [email protected]. We may ask for reasonable verification to protect against unauthorized deletion. We explain the effect on saved progress and any information that must be retained for lawful purposes. Deletion, backup expiry and required retention follow the Privacy Notice and applicable law.

If you request account deletion, we will stop future website subscription renewals under our control as part of closure. Where a store or another seller controls billing, we explain the separate cancellation step and provide the available route. We do not knowingly continue our own recurring website charges after closing the account. Closing an account does not eliminate a valid refund claim or mandatory legal right.

Account-deletion requests also cover your community profile, shared progress, posts and linked community identifiers. Restricted safety evidence and lawful retention exceptions are explained in the Privacy Policy. Turning off progress sharing or leaving a topic group is not, by itself, a request to close your account.

Export or keep any available learning records you want before deletion. We do not promise to restore deleted progress. A retained invoice or fraud-prevention record does not mean the closed learning account remains active or available for reuse.

19 Suspension and termination by LingoTab.com

We may suspend access or end this agreement for a material breach, a credible security threat, payment fraud, ineligibility, or a legal requirement. We act proportionately. Where reasonably possible, we explain the reason and allow a reasonable opportunity to correct a remediable breach. Immediate action may be appropriate where delay would create a serious security, safety or legal risk.

You may ask for review at [email protected]. We consider relevant information and correct mistaken restrictions. Suspension is not an automatic forfeiture of all prepaid money. Refunds, charges for service already supplied, and any losses caused by breach are determined under these Terms and applicable law. We do not keep taking renewal payments for a subscription we have terminated.

If we end paid service for our convenience, we provide reasonable notice where possible and refund the unused portion of prepaid service. We preserve access to applicable account and privacy requests after ordinary learning access ends.

20 Changes availability and interruptions

We may maintain, repair and improve the Services, including by changing AI providers or models. We remain responsible for the obligations in your agreement. A provider's failure does not automatically remove your remedies. Material new data uses require the notices, legal basis and consent applicable to that change.

We do not guarantee continuous availability or that every AI response will be correct. We use reasonable care in providing the Services. Maintenance, technical failures, network problems or events beyond reasonable control may affect access. We will take reasonable steps to address interruptions. A prolonged or material failure remains subject to section 11 and your legal remedies.

If we discontinue a course or material paid feature you purchased, we will give reasonable notice and an appropriate remedy. A materially different course or credit is not automatically a substitute for a required refund. If we close the Services, we will stop future billing and provide a proportionate refund for prepaid service we do not supply, together with any legally required notice and data-access opportunity.

21 Rewards and learning indicators

Points, gems, streaks, badges, study-time estimates and earned activity previews are learning and motivational features. They are not money, cryptocurrency, investments or an accredited proficiency assessment. They cannot be redeemed for cash or transferred or sold unless an express separate offer permits it.

An earned preview grants only the access described by its rules. It does not create a paid subscription or recurring payment authorization. We may correct a clear error or fraudulent award, acting reasonably. Changes to rewards do not remove rights in paid service or allow us to rewrite your actual completed learning history inaccurately.

22 Warranties and educational limitations

We will provide the Services with reasonable care and skill and in accordance with the promises in your agreement. Nothing in these Terms excludes a statutory guarantee, an obligation to supply conforming digital services, a right concerning unfair terms, or a remedy that cannot lawfully be excluded.

Subject to those rights, we do not promise a particular learning result, completely accurate AI output, compatibility with every device, or uninterrupted access. You should not rely on simulated situations or generated content as professional advice. We do not disclaim our own legal duties by describing a feature as experimental or AI-powered. This section does not apply to consumers residing in Quebec; their statutory warranties and remedies apply.

23 Responsibility and limitations of liability

Nothing in this agreement limits liability for fraud, deliberate misconduct, gross negligence, death or personal injury caused by negligence, breach of our confidentiality or personal-information protection obligations, or any other liability that the law does not allow us to limit. It does not limit amounts we must refund or other mandatory consumer remedies.

Subject to the preceding paragraph and section 28, where a limitation is lawful, our aggregate liability for other claims arising from the Services is limited to the greater of CAD 100 and the amount you paid LingoTab.com for the Services in the 12 months before the event giving rise to the claim. Related events are considered together only where applicable law allows that treatment. The cap does not apply where it would be unfair or unenforceable under applicable consumer law.

For personal consumer use, we do not ask you to indemnify LingoTab.com against an unlimited category of third-party claims. Each party remains responsible to the extent the law makes that party responsible. You have no obligation to reimburse a loss caused by our own fault. This section does not apply to consumers residing in Quebec, the EEA, the United Kingdom, Australia or New Zealand; their applicable statutory and ordinary legal rules govern our liability.

24 Communications and changes to these Terms

We may send information needed to administer your account, deliver receipts, provide legally required notices or explain changes to your subscription. We use the contact details you provide and appropriate in-service notices. We handle marketing communications under applicable consent and unsubscribe requirements. Buying a subscription does not automatically subscribe you to optional marketing.

We may update these Terms for changes in law, security, technology or the Services. For a material change affecting an existing agreement, we give at least 30 days' advance notice, and any longer notice required by law, explaining the change, when it takes effect and your options. A change needed urgently to comply with law or address a serious security issue may take effect sooner to the extent lawful, with prompt explanation.

Changes apply prospectively. We obtain fresh agreement where legally required and do not treat silence as consent where express consent is needed. If you do not accept a material change, you can cancel before it takes effect. Where we cannot continue the paid service on the agreed terms, we provide the remedy required by law, including a proportionate refund where appropriate. We retain accessible dated versions of these Terms at [TERMS ARCHIVE URL].

25 Governing law and resolving concerns

Subject to the mandatory laws of your place of residence, this agreement is governed by the laws of [CANADIAN PROVINCE OR TERRITORY TO BE CONFIRMED] and the federal laws of Canada applicable there. This choice does not deprive a consumer of mandatory protection under the law that would otherwise apply.

Please contact [email protected] with a concern so we can try to resolve it. You may use any competent consumer authority, privacy regulator, available dispute-resolution scheme, or court to which applicable law gives you access. Informal contact is not a mandatory waiting period before exercising a legal right.

There is no mandatory arbitration clause or contractual waiver of class, collective or representative proceedings in these Terms. We do not require consumers to bring every dispute exclusively in Canada. Where you have a legal right to proceedings in your home jurisdiction, that right remains available.

26 International access and language

LingoTab.com aims to serve learners internationally. Actual availability depends on applicable law, supported payment methods, provider restrictions and our supported-territory list at [SUPPORTED TERRITORIES URL]. Access to a marketing page does not mean a paid or AI feature is offered in every country. We do not accept an order we cannot lawfully fulfil and then rely on this clause to avoid our obligations.

Neither party is required to perform an act prohibited by applicable sanctions or trade-control laws. Do not conceal a restricted location to obtain unavailable service. If a legal or provider restriction prevents us supplying prepaid service, we address cancellation and refunds in accordance with applicable law.

We make relevant purchase information and contractual notices available in the language required by applicable law. Your learning language or guidance preference is separate from the language of your legal agreement. A translation cannot reduce mandatory local rights. For Quebec consumers, the French-language requirements in section 28 apply. We do not impose an English-prevails clause where the law allows a consumer to rely on another version.

27 Other contract provisions and contact

These Terms, your confirmed order and any specific terms expressly accepted for the purchased feature form your service agreement. They do not exclude representations or statutory obligations that the law treats as part of that agreement. Our Privacy Notice separately explains personal-information handling.

If a provision is unenforceable, the remainder continues only to the extent permitted by law and consistent with a fair agreement. A delay in enforcing a right does not waive it. We may transfer the agreement as part of a lawful corporate reorganization or sale if your rights are preserved; we notify you and obtain consent where required. A transfer does not excuse existing obligations or authorize an undisclosed new use of your personal information.

Provisions concerning outstanding lawful payments, refunds, content rights, privacy, liability and disputes continue after termination only to the extent their nature requires. You may keep a copy of these Terms and your order confirmation.

28 Regional consumer provisions

Canada and Quebec

Canadian provincial and territorial consumer protections apply where required. Our commercial seven-day trial is not a statement that every Canadian online transaction has a seven-day statutory cooling-off period. Your cancellation rights depend on the applicable law and the type of transaction.

For Quebec consumers, mandatory Quebec law governs consumer rights. Sections 22 and 23 do not apply. You retain applicable rights to warranties, cancellation, reimbursement and proceedings. The required French version of the agreement and related documents is made available through a French-language contracting process. Another language is used only through a lawful express choice after the French requirements have been met.

Where Quebec's rules for service contracts involving sequential performance apply to your course, they take priority over ordinary end-of-period cancellation. You may send a written cancellation notice at any time. We charge no cancellation penalty under our policy; we charge only for services lawfully supplied before cancellation and refund any amount the law requires within the applicable deadline. Before sale we supply the course information, prescribed cancellation language and cancellation form, and follow the applicable payment schedule. The general subscription clauses do not waive those requirements.

European Economic Area and United Kingdom

When you are a consumer covered by applicable EEA or UK distance-contract law, you generally have a right to withdraw from a service contract within 14 days after it is made, without giving a reason. We provide the applicable precontract information and confirmation in a form you can keep. If the law provides a longer or extended period, it applies. A trial does not remove that right.

For the service subscription covered by these Terms, we do not ask you to waive withdrawal merely by starting lessons. During the applicable initial statutory withdrawal period, our policy is to honour a withdrawal with a full refund of that purchase, even if you requested immediate access. The additional first-payment guarantee in section 11 remains available. These provisions do not imply that every renewal begins a new statutory withdrawal period; any applicable renewal rights remain protected.

To withdraw, send a clear statement to [email protected] or 5200 Finch Avenue East, Toronto, ON M1S 4Z4, Canada before the applicable period ends. You may use the form below but do not have to. We reimburse the payment using the original method without an additional fee and within 14 days of receiving the withdrawal notice, or sooner where required. We may end the withdrawn paid access. You retain applicable remedies for faulty or nonconforming digital services, required updates, unfair terms, and local court or complaint procedures.

Australia and New Zealand

Australian and New Zealand consumers retain applicable statutory guarantees and remedies, including guarantees concerning reasonable care and skill and fitness for a disclosed purpose where applicable. Sections 22 and 23 do not limit these rights. Our voluntary refund policy does not replace or restrict them.

For Australia, where the Australian Consumer Law applies, you are entitled to cancel the service contract and receive a refund for the unused portion, or compensation for its reduced value, for a major failure with the service. You are also entitled to compensation for other reasonably foreseeable loss or damage. For a failure that is not major, you are entitled to have the failure remedied within a reasonable time; if that does not occur, you may have further cancellation and refund rights. All other applicable guarantees remain available.

For New Zealand, remedies under the Consumer Guarantees Act and Fair Trading Act remain available where those laws apply. Our description of educational limitations does not contract out of consumer guarantees.

Brazil

Where the Brazilian Consumer Defence Code applies, you retain applicable distance-purchase withdrawal rights, including the seven-day right under article 49, and all mandatory refund and service-quality rights. The relevant period runs from the event specified by applicable law. Our seven-day commercial trial is a separate offer and does not shorten or replace a legal withdrawal right. A withdrawal may be sent through our online support route or the contacts above. We provide required refunds and comply with applicable local disclosure and language requirements.

United States and other locations

Applicable federal, state and local consumer laws govern automatic-renewal consent, disclosures, reminders, cancellation, refunds and unfair terms. We provide any additional notices and cancellation controls those laws require. These Terms do not impose arbitration or waive collective proceedings. Any applicable privacy rights are explained separately in our Privacy Notice.

If you live elsewhere, you retain the mandatory protections of your jurisdiction, including any applicable withdrawal period, required local-language information, consumer guarantee or local dispute procedure. A regional provision here is not an assertion that LingoTab.com has already launched in that region. Availability is identified before an order is accepted.
